Terms of Service

Ema Media Group LLC · Last updated: October 3, 2026

These terms apply when you buy services from Ema Media Group LLC (“EMA,” “we,” “us”) and when you use emamediagroup.com. By buying from us or using the site, you agree to them. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.

1. What We Do

EMA provides marketing services to small businesses: websites, hosting and website care, local SEO and Google Business Profile work, social media setup and management, short-form content edited from footage you supply, AI website chat and AI phone answering, CRM setup, follow-up automation, review generation, email and SMS campaigns, paid advertising management, and business setup assistance. The exact scope is whatever your package, plan, or proposal describes at the time you buy.

2. What We Do Not Do

We do not film video or shoot photography as part of our standard packages — we edit footage you provide. We do not provide legal, tax, accounting, or investment advice. Business setup services are document preparation and filing assistance only. They are not legal advice and do not create an attorney-client relationship. You should have your own attorney review anything that matters to you.

3. Buying and Payment

Prices are shown on our website and in your proposal. Payments are processed by Stripe. One-time packages require a 50% deposit to begin, with the balance due at delivery. Monthly and yearly plans bill automatically on the same date each period until cancelled. Setup fees are charged once. All prices are in US dollars and exclude any applicable taxes.

4. Cancellation and Refunds

These are set out in full in our Refund and Cancellation Policy, which forms part of these terms.

5. Advertising Spend

Advertising budgets are paid by you directly to the platform — Google, Meta, or others — from your own account. Ad spend is separate from our fee, is not refundable by us, and we do not control platform pricing or policy. Recommended minimum budgets we suggest are recommendations, not guarantees.

6. What You Provide

To do the work we need things from you: access to the accounts we are managing, content, approvals, and answers to our onboarding form. If we are waiting on you, timelines move accordingly. If we are waiting on you for more than 60 days on a one-time package, we may close the project as delivered.

7. Ownership

Your accounts stay yours. Your domain, Google Business Profile, social media accounts, and advertising accounts remain in your name during and after our work together. Your deliverables are yours: once a project is paid in full, you own the finished work we produced for you, including your website content, graphics, and copy. Our systems stay ours: we retain ownership of our templates, workflows, automations, snapshots, and processes, and of the software licences we use to deliver the service. A monthly plan includes the use of our platform while the plan is active. If you cancel, we will help you export your contacts and data, but platform access and our automations end.

8. Included Work and Extra Work

Monthly plans include a set amount of edit time each month: 1 hour on Essentials, 2 hours on Growth, 3 hours on Pro. Unused time does not roll over. Work beyond that is billed at $75 per hour, quoted and approved by you before we begin. Calls, texts, and AI minutes are included for normal business use. If usage runs well above normal, we will contact you before anything changes.

9. Results

We do not guarantee rankings, leads, sales, or revenue. Marketing results depend on your market, your pricing, your offer, your competitors, how quickly you respond to leads, and platform algorithms we do not control. Any timeframes we give are estimates based on experience, not promises.

10. Reviews and Testimonials

We request reviews only from your real customers, about real experiences. We will not write fake reviews, purchase reviews, or offer incentives in exchange for reviews. This is prohibited by FTC rules and platform policy, and we will decline if asked.

11. Your Content and Conduct

You confirm you hold the rights to any logos, photos, footage, text, or music you give us, and that what you ask us to publish is accurate and lawful. You agree not to ask us to market anything illegal or deceptive, or to market a regulated service you are not licensed to provide.

12. Regulated and Sensitive Industries

If your business handles protected health information, we require a separate written agreement before we handle any of it. We do not accept payment calculated per patient, per resident, or per person placed in health, housing, or recovery settings.

13. Confidentiality

Each of us will keep the other’s non-public business information confidential and use it only to perform or receive the services.

14. Communications

By giving us your phone number you agree that we may contact you about your account. Marketing text messages require separate opt-in and are governed by our SMS Terms. Reply STOP at any time to opt out.

15. Suspension and Termination

We may pause or end services if an invoice is more than 15 days overdue, if required by law or platform policy, or if the work would require us to do something deceptive or unlawful. You may cancel as described in the Refund and Cancellation Policy.

16. Liability

To the fullest extent permitted by law, our total liability for any claim arising out of our services is limited to the amount you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost profits or lost business. Nothing here limits liability that cannot lawfully be limited.

17. Third-Party Platforms

Our services run on third-party platforms. We are not responsible for their outages, policy changes, account suspensions, or price changes, though we will help you work through them.

18. Use of This Website

Content on emamediagroup.com is owned by or licensed to us. Please do not copy, scrape, or republish it without permission. The site is provided as-is.

19. Changes to These Terms

We may update these terms. The version in effect when you buy is the version that applies to that purchase. The updated date appears at the top.

20. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, and any dispute will be brought in the state or federal courts located in Massachusetts. Before filing anything, both sides agree to try to resolve the matter directly — email admin@emamediagroup.com and we will respond.

21. Everything Else

If any part of these terms is unenforceable, the rest remains in force. These terms, together with your proposal or order, the Refund and Cancellation Policy, and the SMS Terms, form the entire agreement between us.
